THC CBD oil for medical treatment now legal in Kansas – WIBW

TOPEKA, Kan. (WIBW) — A new law allowing people with life-threatening medical conditions to get treatment with CBD oil that contains a small amount of THC has gone into effect.

The measure was pushed by Gwen and Scott Hartley, who said it could save the life of their 12-year-old daughter, Lola. She suffers from microcephaly, a medical condition in which a child’s brain doesn’t fully develop and the child has an abnormally small head for his or her age.

The condition has already claimed the life of Lola’s older sister, Claire, who died at the age of 17 in December 2018. The bill, officially known as Senate Bill 28, became known as „Claire and Lola’s bill,” after the Hartley girls. It went into effect on July 1.

According to the Governor’s Office, the new law provides an affirmative defense for possessing cannabidiol with tetrahydrocannabinol to treat certain medical conditions. It also bars agencies from removing children from the homes of parents for possessing or using the CBD oil for medical treatment.
