CBD Retailer Says Dosage Suit Doesn’t Show Actual Injury – Law360

Law360 (November 15, 2019, 6:43 PM EST) — A Florida cannabidiol retailer has asked a federal court to toss a proposed class action claiming its products do not contain the advertised amounts of CBD, saying federal regulation allows some leeway for actual amounts of natural nutrients in dietary ingredients.

Calling the claims of Kathryn Potter and the proposed classes “a class action in search of an injury,” retailer Diamond CBD said in Thursday’s motion to dismiss that the allegations also failed to adequately show any concrete injury.
