For many, the prohibition of cannabis has meant a lifetime of being labeled a criminal. Before the first states voted to legalize recreational use of the substance in 2012 and even to this day, being convicted for marijuana-related offenses has caused undue difficulty in finding employment, brought crippling fines, and even years of jail time for millions of Americans.

States like Massachusetts have sought to right this wrong by implementing social equity programs to help individuals convicted for marijuana offenses acquire licenses to open and operate cannabis businesses. These programs provide capital, education, and technical training to those who qualify.

The regulatory body responsible for overseeing the industry is the Cannabis Control Commission, a state agency that grants licenses to companies, distributes social equity benefits, and monitors legal compliance.

Social equity programs are meant to acknowledge and “repair the harms that the drug war did to people” in vulnerable communities, who tend to be people of color, said Shaleen Title, who served as a CCC commissioner from 2017 to 2020.

“It helped to make sure that entrepreneurs that came from communities harmed by the drug war have some extra benefits to opening a business,” she said. 

Title is now co-founder and CEO of the Parabola Center, a nonprofit think tank “which creates drug policy that is not influenced by corps and focused on people.”

As the industry has grown, so have concerns of big businesses dominating the market. Part of the CCC’s work has been devoted to keeping the playing field level for prospective social equity applicants.

The market is kept fair by limiting individuals and businesses to holding up to three of each type of license: retail, manufacturing, and cultivation. Medical licenses encompass all three of these categories.

According to the CCC’s current executive director Shawn Collins, the industry’s economic landscape could soon be shaken up by social consumption in “cannabis cafes” and, later down the road, federal legalization.

Collins said cafes are the “next step in legalization,” and would require a new type of license that would be available “exclusively” to social equity applicants for a three-year period. Before this can happen though, he said certain issues have to be ironed out.

More research must be done into the effects of secondhand marijuana smoke, he said, as well as better methods for preventing and detecting driving under the influence of cannabis.

Another major development in the Bay State cannabis industry is delivery. Devin Alexander is the CEO and co-founder of Rolling Releaf in Newton, and was among the first to receive a social equity license. Alexander, 28, was arrested in high school for marijuana possession.

Rolling Releaf delivery opened earlier this year. Alexander said the hardest aspect of opening a cannabis business is accumulating the funds to compete with larger companies.

“It comes down to access to capital,” he said. “We need a robust social equity program.”

James Smith, a partner at the public policy law group Smith, Costello, and Crawford, has been working with and representing cannabis-related clients since 2012. The company currently represents nearly 40 clients.

Smith reaffirmed the importance of capital in successfully opening a cannabis business, an asset in short supply even with the proliferation of social equity benefits. He also said business acumen and “passion for the product” as must-haves for entrepreneurs.

“If you don’t have those three items,” he said, “I don’t care who you are, you’re not going to make it.”

Even if an individual has the knowledge, passion, and capital, the market’s cutthroat competition and “remarkable” cost of doing business still imposes a significant barrier to success. By limiting the number of licenses a company can acquire, it’s difficult to point out a single dominating marijuana purveyor.

As opposed to the monolithic Big Tobacco, Smith said the emergence of “big marijuana” is unlikely given the current legal and economic landscape of the market. He thanked the state’s social equity laws for keeping the industry at least somewhat accessible, and expressed the hope that they are here to stay.

State Rep. Daniel Donahue, D-Worcester, a member of the Legislature’s Cannabis Committee, shares Smith’s hope for the future and believes there will “still be a need” for social equity as the industry continues to grow and change over time.

“We’re cognizant of justice issues,” he said, adding that the continuation of the social equity program can be part of the solution to these ongoing issues.

Some legislators from across the aisle have also reaffirmed the importance of a social equity program in a functioning marijuana market.

State Sen. Ryan Fattman, R-Sutton, said in a statement, “I believe that it is important to be inclusive and equitable for all that are trying to work in this industry … we must be persistent in our pursuit of equity of opportunity in our economy today.”

Other Republicans, though, still have reservations about the equity program.

State Rep. Paul Frost, R-Auburn, said that he supports the idea of making capital more accessible to people who otherwise wouldn’t be able to afford the cost of breaking into the industry, but not necessarily to those with a criminal record.

“The only people who seem to be able to get the backing to get into the industry are very wealthy people,” he said, adding he would like to see more support for “mom and pop” shops.

As for social equity applicants, though, he is not so sure.

“I understand there can be people who may have been doing something recreationally, by themselves, and got busted for it 20 years ago,” he said, and doesn’t think this should disqualify applicants from opening up shop.

What concerns Frost are individuals who may have illegally sold marijuana, or were otherwise involved in the black market.

“That concerns me because you broke the law back then, how do I know you’re not going to break the law now?” he asked.

He emphasized there are changes to the social equity program still making their way through the legislative process, and once this is done he’ll be able to better decide who should be granted special licenses.

Frost, Donahue, and others in the Legislature are keenly aware of the economic obstacles prospective entrepreneurs face when trying to break into the market.

In addition to a lack of capital, Donahue said entrepreneurs are at risk of falling victim to “predatory loans or capital schemes” that can make their situation even worse.

Warren Lynch, a 47-year-old social equity applicant from Malden experienced similar pitfalls when he tried to open a cannabis business in 2017.

Lynch thinks his troubles are thanks to the host community agreements municipalities and potential cannabis enterprises must abide by in order to do business.

“A lot of cities and towns make it really hard for small businesses on purpose because they want to maximize income,” he said.

In Massachusetts, municipalities can require cannabis businesses to pay fees in order to operate. Social equity applicants can get “squeezed out” by exorbitant fees, which is what Lynch said happened to him when he tried to open a business in Salem.

Despite the perceived hostility from cities and towns around the state, Lynch is optimistic about the future of cannabis and will keep trying to break into the rapidly growing industry.

“This is our home,” he said. “We live here, and we’re going to try really hard to open here.”

Cannabis users, your weed may not be what you think it is – KCRW

When you walk into your neighborhood pot shop, you’ve got three basic choices: indica, sativa or a  hybrid of the two.

However, what you see might not be what you get. The most common ways cannabis strains are categorized could be misleading, according to a new study. Leafly Senior Editor David Downs breaks down how inaccurate product labeling can be. 

What are indica, sativa and hybrids?

David Downs: They were the three basic ways we used to classify pot when it was just pot. 

It started out by how it was grown. Indica plants are smaller and bushier. Sativa plants are taller and more airy. Hybrids tend to be a mix of the two.  That’s because sativa has evolved in the tropics, and indica has evolved in the mountains

There [were] some initial morphological differences in those plants that growers thought mapped to different chemicals in the plants and thus, different effects in the plants. That’s why we ended up with indica, sativa and hybrid as the three broad categorizations you’ll see when you go into a dispensary and look at a menu.

What did the study find?

The indica-sativa-hybrid classification system may be not very helpful when it comes to determining the actual effect of the cannabis you’re taking. 

This new study was published in PLOS ONE by University of Colorado Boulder researchers as well as Leafly. It looked at 89,923 lab samples sent to cannabis labs in six states. Those labs analyzed the samples for THC and CBD, the main active ingredients in cannabis, as well as the terpenes, the aromatic molecules, to see if those samples correlated with the labels for indica, sativa and hybrids. 

It then [looked at] the specific strain names, like Blue Dream, of which there are 6,000 or more in the Leafly database.

What about strain names? 

They don’t line up with the indica, sativa and hybrid designations, but strain names can correlate to the terpenes and the THC, and thus the effects in cannabis. 

Really popular strains like Purple Punch or White Tahoe Cookies generally have the same chemotype wherever you buy it, but older strains that have drifted over time like a Tangie or a Durban have less of that correlation. 

Instead, the study found that there are three main terpene types or clusters across all cannabis in America that are only loosely related to indica, sativa and hybrid.

Any caveats to the study?

We’re learning that not all terpenes are created equal. Minor ones may have outsize effects compared to their weight, and people’s bodies are different. 

Another caveat is that there’s more than terpenes in cannabis, and they’re not necessarily being tested. Scientists are finding things like volatile sulfur compounds, or phenols. Lab standards also vary. We’re very much in the infancy of cannabis science.

What does this mean for consumers? 

I think the big takeaway is to know THC. You’re gonna see a THC percentage on things, and that THC percentage really does drive a lot of the effects of cannabis in terms of the high or the euphoria. 

Some people say, “I don’t enjoy marijuana. I don’t enjoy how it makes me feel.” That’s usually related to the THC content in it, which can be up to like 25 to 30% now, and really high. Those people might want to try the second most common cannabinoid in marijuana, cannabidiol, which has a different effect at the nerve level than THC. 

If indica, sativa and hybrid are working for you, that’s fine. But if it’s not, there’s another layer you can go down, and that is into the terpenes where you might find things that do work for you better than the old classification system.

How can consumers know what they are buying?

One thing I’m telling people is to follow your nose. Your nose is very sensitive and powerful, and it’s really associated with memory. You’re going to have a memory feeling for what’s good or bad in terms of your past experience with cannabis. 

Another one is to get fresh cannabis. Look at those terpenes to find correlations with effect but, also now look at the manufacturer’s date. 

There’s more old cannabis on shelves in legal stores than ever. You want to look for fresh cannabis because it’s an agricultural product, and it’s degrading over time. Even if you’re right in the ballpark for the terpenes you want, if that jar is 6 months old, those terpenes might be long gone.

The Cannabis Supper Club Elevates Weed-Infused Fine Dining – Forbes

Sipping smoke out of a champagne glass, our server too-casually offers up seven courses of mind-blowing culinary creations infused with weed. The decadent Cannabis Supper Club strikes again.

Chefs of Amiga Amore cooked their unique Italian-meets-Spanish fusion for the crowd this evening at The 91 Club, a cannabis-friendly event space in the heart of downtown LA. The Cannabis Supper Club has been popping up around the city, showcasing the talent of different chefs, cannabis brands, and selling out dinners twice monthly since its founding in 2017. The formula works because it orbits Angelenos’ two favorite things: food and cannabis.

Marc Leibel is the mind behind the Cannabis Supper Club, a self-proclaimed foodie with his own chef background. “To elevate the dining experience with cannabis, I really fell in love with it,” says Leibel. Since the comfort of a dining experience is familiar and accessible, Leibel says, it’s a great way to incorporate cannabis brands people may not know about.

As the name suggests, these suppers include a wide array of weed brands. This time around, guests were treated to MyHi mixing up cannabis beverages, THC Design offering joints, and The Hashinista’s Elise McRoberts showcasing Shackow Farm’s rosin at a neon pink-light-soaked dab bar. The dinner also featured ancillary companies like the cannabis-centric cultural publication Skunk Magazine, and the psychedelic artist Linzy Miggantz.

Founded in 2019, The Hashinista is a pop-up that brings hash and cannabis concentrates to events like weddings, private dinners, and larger-scale consumption gatherings. For the evening’s festivities, McRoberts partnered with Schackow Farms based in Humboldt, whose hash is a labor of love made by Matt Schackow, a 15-year veteran grower and hash maker.

“It’s really exciting because I specialize in working with legacy farmers,” says McRoberts. “I’m happy to have a new hash maker I can help get out to the people. It’s about promoting the sun-grown, small farmer, one guy growing on an acre, making amazing hash. It’s exciting that I get to work with something I love.”

Amiga Amore founder and chef Danielle Duran-Zecca spoke to me about her process when building a menu with cannabis pairings: “I like to get wildly creative. Amiga Amore is my husband and I, so it’s Mex-Italian. We usually smoke a fat joint and go for a walk and I get excited about the menu. But really, it’s about certain pairings. Citrus flavors that really go with Mexican flavors like agua chile, playing with those bright notes.”

This dinner is as elevated as munchies get. Chef Duran-Zecca took the stoned, laughing diners on a nostalgic and unique culinary journey that melds her cooking style with the style of her Italian husband. She is more focused on the pairing than infusion, but guests were given the option of adding edible tincture to their dishes equalling about 25 milligrams. It tasted divine. The team at THC Design walked around with a crystal bowl filled with joints, a sativa that paired well with the Intermezzo course.

“It’s food that kind of makes you think twice about it,” says Duran-Zecca. “It’s a cannoli, the first thing that we eat is a cannoli, but it’s savory. Then we have the squash blossom with not just a mole, but a cherry mole. It continues on with progression to the pasta dish, its duck egg center is very interactive.” Duran-Zecca and her partner use only what’s in season. “We go to the farmer’s market, and get inspired by all of it.”

The Amiga Amore duo turned our expectations for a normal coursed menu on its head. “It’s a mind fuck,” says Duran-Zecca, “When we bring out the cannoli, people think, like, ‘wait are we going to have something sweet?’ The last dish is plated in a way that it’s hidden underneath a foam. The food is interactive. Our lemon granita is a take on a Mexican fruit cart: chamoy, tajin, with the classic lemon flavors to cleanse your palette.”

The menu and entire seven-course journey paid homage to the chefs’ heritage. “I’m originally from LA,” says Duran-Zecca. “Coming back to my hometown, being able to make food that really means something to me, feels great. But also, my goal is to get my husband to like it, since he is my biggest critic. He enjoys flavors now that he didn’t know existed. This meal is really an elevated take on it.”

UB Preserv space to become a CBD coffee shop and cocktail bar – Chron

Neighborhoods change fast in Houston. The former UB Preserv space at 1609 Westheimer now has a new tenant: a CBD coffee shop and cocktail bar.

Wild, a concept from the team behind Grinders Coffee Bar and The CBD Apothecary, opened its first location in the Heights in February. It serves coffee, cocktails and other drinks, both infused with CBD and not. The dispensary side sells hemp products from Texas brands as well as their own, such as gummies and oils.

Wild in the Heights is dedicated to hemp-infused coffee, cocktails and baked goods.

UB Preserv was Chris Shepherd’s acclaimed Montrose restaurant, helmed by chef Nick Wong. It closed this year, along with all of Shepherd’s other concepts on Westheimer.

When the closure was announced, Shepherd said he intended to turn it into a Foo Fighters-themed bar called Everlong Bar & Hideaway. But a few months later, the idea was shelved and Underbelly Hospitality partners began to look for someone to take over the lease.

UB Preserv opened in 2018, meant to be a continuation of Underbelly, the restaurant that launched Shepherd to fame, but also ended up closing that year.

UB Preserv had its last service on Dec. 23, 2021. It was dormant for a while, then a hot-pink sign announcing the arrival of Wild popped up. An opening date for the second location of Wild, and details about how it will be different and what will be done to the space, were not available at press time.

If it’s anything like the original outpost, you’ll be able to find cocktails such as the Flower Power, made with Fords gin, Italicus bergamot liqueur, butterfly pea flower and lemon; and a food menu featuring small plates like empanadas, Thai meatballs, sliders, a banh mi and charcuterie.

Wild brews its own line of coffee beans and can infuse drinks with CBD or Delta-8. The dispensary also carries non-edible hemp products like bath bombs and lotions.
